yeah i think so it wont get through because i will tell you currently i work as a consultant for a very big company, fortune 500 company and they even work on projects for US govt. what does it make them -- not consulting company? they cant be prohibited from hiring ppl on H1 or hiring consultants on H1? the bill wont see the light of the day -- i am sure.

You have rekindled my interest. I am not a lawyer but have been in a job that required reading contracts and legal matters. Your points made me think that we may have some case here. So if you are intersted we could take some legal opinion. If four or five people can join then we can share the cost for the initial consultation.

if people have to debate this issue, surely we can do it without needless slander and accusations?
i agree with GC applicant, words like that do not sound right and have no place here please.
btw when the vertical spillover started, there was alot of angst, these last two years all retrogressed categories except EB3 ROW have suffered. so that is not true either. except that there was frankly nothing we could do about it. there were long debates similar to the current ones- then they were between Eb2I and EB3 ROW and no conclusion was reached of course, and nothing changed by screaming at each other. finally USCIS as stated by them, has taken counsel about that "change" they made and concluded that they made an error in interpretation. what they have actually done now is rolled back a change they previosuly made.
i also want to say to all the EB2 I crowd here- all this chest thumping is pointless. EB2 I will go back, a lot, this is just a temporary flood gate to use the remaining Gc numbers for the year. meanwhile, the plight of EB3I is truly bad. lets please keep working on the recapture/exemption/ country quota bill trio that would incraese available Gc numbers- for ALL our sakes.

1. Is IV officially and specifically endorsing this consideration campaign of giving numbers to EB3 based on the letter.
2. If not, then the implication in the letter is that IV is doing so based on the logo used.
3. Lets take a step back and think over what the letter/campaign/posts in this thread are asking the USCIS to do.
4. There is a request to allocate numbers to EB3 based on length of wait.
5. These numbers can only come from EB1 or EB2 given that the pie is not going to grow pending new legislation.
6. If we accept that EB2ROW spill over can go only to EB2-Retro and only after EB2-Retro becomes current can they flow to EB3 (ROW/Retro) then the only source of visa numbers for EB3-Retro becomes EB1 spill over.
7. We are then saying that some EB1 spill over should go to both EB2 retro and EB3 ROW/retro. Even in this case EB3 ROW has to become current, then satisfy EB2-Retro and only then flow down to EB3-Retro.
8. If this is the case then one of two things can happen. Either the spill over from EB1 is small enough to satisfy EB3 ROW and EB2-Retro partially leaving EB3-Retro still high and dry or the spill over is so large that it makes EB3ROW current, EB2-Retro current and moves EB3-Retro forward. I cannot agree more. I have been trying to drill this into some peoples brain but they are so adamant on renting and has made this thread into a rent vs buy argument. I finally gave up. I am not saying that this is the right time to buy. Fast forward 2 or 2+ years, lets assume the market is good. Then when it comes to rent vs buy I advocate buying a house.
Let?s say you have a small kid and you are living in an apartment, after 10 years you save enough money to buy a big house and you then eventually you buy it. Then you ask the your kid ?do you like the house??. He will reply ?it?s very nice dad, but can you give you give my childhood now?.?. Go figure out guys. If you are not planning on going back for a very long time then at-least get a life in the country you reside and when the housing market is good.
I think the point is valid to an extent, but the original post was about buying it during I-485 implying the concern about uncertainity that comes along and about financial investment, associated risks.
I have bought house in April 2006 while on H1. When my wife got job 2 hours away from our home, I had to take apartment to maintain sanity in life and not spend 4 hours a day commuting. For about a year I maintained 2 homes. I was looking at a 35K loss on a 285K home after factoring in selling expenses of 6% if I had to sell. And it'd take 4 months to sell. SO I just held up and luckliy she got another one closer home and we are able to come back to our home.
I definetely missed the flexibility that I'd have if I didnt buy home.
If you rent a town home or even a single family home, you get best of both worlds of not having to commit yourself for big decision at the same time enjoying a larger home, neighbourhood where kids can grow etc etc.
One note of caution for would-be home buyers is to budget conservatively. Utility bills will throw a nasty surprise. In a 1000 Sq.ft apartment , your utilities for gas and electricity will top $125. Prepare to spend about 500$ in winter months. Your new home's volume is 4X your apartment for a typical 4 BR home. Also garbage, sewer, water are extra which are generally included in rent.
Ofcourse purely from an investment perspective, there are far better avenues to invest than a Home at this time

hi Guys,
I was thinking over this for quite some time. Why dont we hire one or two immigration attorneys on a full time basis. And lets start am immigration office where we can have all our immigration works (doubtful) but the future immigrant works ata marginally cheaper rates with high quality of service. If we keep a no profit no loss mantra, it would be helpful to everyone and also it will make this organization very strong.
Lets discuss its relevance? What does the Core think about this.?

When the Democrats won control of Congress a year ago, they promised bold new leadership. Things would change, they said. They had a mandate.
But they didn't have the votes to stand up to veto threats by Bush and filibusters by Senate Republicans. They didn't have the bold new leadership, either. A year later, Congress is lamer than the lame-duck president.
On the Democrats' No. 1 issue, the war in Iraq, it's been a year of defeat and surrender. They were going to "bring the troops home." Instead, President Bush sent more troops to Iraq. The "surge," coupled with a new counter-insurgency strategy, has led to a sharp decline in military and civilian deaths. All attempts to link war funding to a withdrawal timetable fizzled. Giving up completely, Congress passed $70 billion in no-strings war funding before the Christmas recess.
Democratic leaders blame their impotence on Bush's obstinacy. Bush didn't compromise. He didn't have to.
Democrats talked about limiting the excesses of the Patriot Act, banning cruel CIA interrogation tactics and closing the Guant?namo Bay internment camp. Didn't happen.
Instead, Congress authorized warrantless surveillance for six months by passing the Protect America Act before the August recess. Democrats were forced to push discussion on making the surveillance rules permanent into January. Bush will likely win this one, too.
After months of wrangling, Congress approved an omnibus budget bill that gave Bush the spending levels he wanted.
Promising fiscal discipline, the Democrats vowed to pay for any tax cuts with tax increases elsewhere or spending cuts. That "pay as you go pledge" was put aside to pass a popular bill protecting 23 million middle- and upper-middle-class taxpayers from paying $2,000 extra under the alternative minimum tax. Since the tax was originally designed to prevent the super-rich from using tax shelters, conservative Democrats tried to close tax shelters used by super-rich hedge-fund managers to cover the $50 million revenue loss. They lost.
Congress made baby steps toward fiscal discipline by trimming "earmarks" for pet projects by 25 percent from 2006, estimates Taxpayers for Common Sense. But legislators OK'd more than $15 billion for more than 11,000 pork-barrel projects.
President Bush didn't win them all: Social Security reform went nowhere, reauthorization of No Child Left Behind was postponed to 2008 and he couldn't rally enough Republicans to pass a complex and controversial immigration bill.
But this wasn't supposed to be his year. The triumphant Democrats made big promises a year ago, but delivered modest results. Democrats increased the minimum wage, enacted the Sept. 11 commission's recommendations into law and expanded student loans.
Most notable was the energy bill, which included the first increase in fuel efficiency standards for cars and light trucks in 32 years.
However, Democrats dropped plans to repeal tax breaks for oil companies and require more use of alternative energy. Bush insisted. Congress caved.
On other issues, Congress acted and Bush vetoed. Congress expanded health insurance for children and approved federal funding for stem cell research, but couldn't overcome Bush's "no" vote.
Stymied repeatedly, Congress saw its approval ratings fall to record lows. When you're less popular than George W. Bush, you're pretty darned unpopular.
"I don't approve of Congress, because we haven't . . . been effective in ending the war in Iraq," House Speaker Nancy Pelosi of San Francisco told reporters in response to the polls. "And if you asked me in a phone call, as ardent a Democrat as I am, I would disapprove of Congress as well."
2008 will be a year of partisan politics. No doubt Republicans will run against the do-nothing Congress. That could backfire. Democrats will tell voters that if they want Democratic policies - and most people tell pollsters they do - they need to put a Democrat in the White House in 2008.

President Bush didn't win them all: Social Security reform went nowhere, reauthorization of No Child Left Behind was postponed to 2008 and he couldn't rally enough Republicans to pass a complex and controversial immigration bill.
But this wasn't supposed to be his year. The triumphant Democrats made big promises a year ago, but delivered modest results. Democrats increased the minimum wage, enacted the Sept. 11 commission's recommendations into law and expanded student loans.
Most notable was the energy bill, which included the first increase in fuel efficiency standards for cars and light trucks in 32 years.
However, Democrats dropped plans to repeal tax breaks for oil companies and require more use of alternative energy. Bush insisted. Congress caved.
On other issues, Congress acted and Bush vetoed. Congress expanded health insurance for children and approved federal funding for stem cell research, but couldn't overcome Bush's "no" vote.
Stymied repeatedly, Congress saw its approval ratings fall to record lows. When you're less popular than George W. Bush, you're pretty darned unpopular.
"I don't approve of Congress, because we haven't . . . been effective in ending the war in Iraq," House Speaker Nancy Pelosi of San Francisco told reporters in response to the polls. "And if you asked me in a phone call, as ardent a Democrat as I am, I would disapprove of Congress as well."
2008 will be a year of partisan politics. No doubt Republicans will run against the do-nothing Congress. That could backfire. Democrats will tell voters that if they want Democratic policies - and most people tell pollsters they do - they need to put a Democrat in the White House in 2008.
For the next 11 months we can expect more of the same from the lame duck and lamer Congress.

After those appearances, Silvertooth found that opponents of the measure had a few choice words of their own, which they would leave on his office voice mail.
?People would leave profane messages,? he said. ?They wanted to know why we hate America. Why we can?t hire Americans. How much I am getting from the Mexican government.?
The issue tends to bring out the ?worst in people,? he said. ?It?s overly emotional.?
Silvertooth blames the intense anger for scaring members off the bill, which he contends offered a reasonable response to a labor shortage his industry and other contractors face.
To critics, through, the bill offered amnesty to illegal immigrants. The three weeks between when Senate Majority Leader Harry Reid (D-Nev.) pulled the bill from the floor and when he brought it back up again ?provided ample time for talk radio and other media opponents, including blogs, to mobilize,? according to Silvertooth. He estimates his side lost three or four votes during that time.
One consequence of the bill?s failure is that Silvertooth is off the hot seat. With comprehensive reform dead, he doesn?t appear on TV anymore. But the issue hasn?t gone away for his industry.
Silvertooth?s group is now part of an effort to block a Bush administration effort to go after employers that use illegal workers through a so-called ?no-match? rule. His work for EWIC keeps him active in efforts to tweak immigration laws through less ambitious measures that, for example, target H-1B visas used by high-tech companies.
Contractor groups like the roofers? association, though, still await comprehensive reform. The sector employs nearly 12 million people, with about a quarter of the workers having Hispanic roots. The Bureau of Labor Statistics estimated in 2005 that nearly 30 percent of the roofing workforce was undocumented.
?This is life or death for the industry. We are not finding native-born Americans that are willing to go into our industry,? he said.
Given the stakes for contractors, various trade groups and companies banded together to form EWIC.
Lake Coulson, a lobbyist for the Plumbing, Heating and Cooling Contractors National Association, called EWIC the ?biggest and most important? of all the immigration coalitions pushing reform.
?As one of the co-chairs of EWIC, he was front and center in the debate,? Coulson said of Silvertooth. ?He?s been a terrific ally.? Coulson credited Silvertooth for keeping the coalition together and selling components of the compromise members didn?t support in hope of keeping the bill alive and moving it forward.
A native of Texas, Silvertooth was a former staff aide to Sens. Phil Gramm (R-Texas) and Kay Bailey Hutchison (R-Texas) before working on Robert Dole?s 1996 presidential campaign.
He then worked as a fundraiser for Georgetown University before becoming a lobbyist for a trade group of air conditioner manufacturers. Silvertooth has worked at the roofers? association for the last five and a half years.
Founded in 1886, the association is one of the oldest trade groups in town. It now represents 4,200 companies, mostly small businesses with fewer than 35 employees each.
Those businesses are going to have a hard time complying with the no-match rule. The effort, led by the Department of Homeland Security, would create new responsibilities for employers to ensure their workers have proper documentation, and new penalties for failing to comply.
Government estimates are that there are 17.5 million errors in the Social Security database. An error occurs when information in the database doesn?t match the information sent by an employee or an employer. But there are only an estimated 11.6 million illegal immigrants.
The NRCA has joined the United Fresh Produce Association, the American Nursery and Landscape Association, the U.S. Chamber of Commerce and the International Franchise Association in an effort to block the implementation of the Bush plan in federal court.
?We?re playing defense. We used to have a game on both sides of the ball, but with the death of comprehensive reform in the Senate, our offensive game is out the window,? Silvertooth said.
?Hopefully, the 111th Congress will be more amenable to reform.?
By then, Silvertooth may play a less central role in the debate. He is soon to take over as executive director of a spin-off trade group that will focus on green-building standards. The group does not yet have a name.
While that debate promises to be less controversial than the one on immigration, roofers did have some concerns with efforts by Democrats to raise new energy standards for buildings. The NRCA was one of a dozen groups that wrote House members to express concern with a bill to promote energy efficiency standards. The measure would have imposed ?aggressive efficiency benchmarks for building codes that may not be technically feasible or economically justified by the targeted dates,? the letter stated.
In this instance, lawmakers heard the concerns and adopted an amendment to the bill giving the Energy Department the power to ensure new standards could be met without creating economic damage to the building industries.

But congress needs to find some solution for H1b mess like applying 150k H1b in one day. If no alternative solution is suggested some part/all part of this bill may be considered. US companies will not be impacted as they are not h1b dependent and they are hiring more than 50% US workers so they may not oppose that much. If Microsoft lobby for 200k H1b but still if they could not get any h1b why will they lobby it? American companies will either ask unlimited H1b or restrictions for bodyshopping so that everyone will get fair share of H1b. Lottery is shame as many deserving candidates will be rejected but many lower grade people may enter there is no merrit in selection of H1b. If IV is opposing this they need to give some solution for H1b mess. Otherwise no point. Also the bill was introduced by both Democrat and Republican. So Whether it is passed or not it is going to be considered

Hi,
I applied for GC under schedule A in may06 .My husband filed as derivative.He received a notice of intent to denial last month .Reason being he did not have paystubs for a period of more than 6 months during 2000 and 2001.His employer at that time did not pay him even after he worked for 4 months then he took few more months to change his company(more than 180 days)In 2002 he went to India and came back .and in 2004 filed for a GC as primary petitioner and me as a derivative .last year he withdrew the petition after he received several RFE`S fearing the worst.Even though he no longer has GC filed as primary petitioner he received notice of intent to deny for the petion filed through me saying that his H1 was not legal as could`nt show proof for several months and that when he filed for AOS he used those years as work experience.
and now another problem is I applied for EAD in march and have not received new ead.my old ead expired 10 days ago.and now Iam not working.
We bought a house last year thinking that under schedule A we`ll get GC in no time.Now we know it is a terrible mistake.Now both of us can`t work and had to take my son out of daycare. and we have house payments to make.We put our house for sale weeks ago and so far no offers.I contacted local representative to expedite My EAD and also contacted USCIS to expedite it,
citing financial burden.We are spending sleepless nights and have no clue what to do for my EAD and his AOS.pLEASE HELP.
Did anyone face similar situation .Any suggestions are welcome.
Sad to hear your story. Talk to an attorney ASAP. Maybe to several attorneys to get different opinions and perspectives. Time is of the essence in you case. Contact a financial planner/realtor as well to see what you can do about your house payments.

Now, immigration matters are totally irrelevant on the forums. Heck, forget about being an exclusively India focused forum, as this thread demonstrates, it is a venue to vent on matters even more narrowly focused - My religion, my sect, my opinion, my petty prejudices. If this is not irrelevant enough, we have enough threads on red dot-green dots to justify a whole separate category of forums :rolleyes:
