2. What are the risks in doing so?
3. Does the time you were out of country counts towards your h1 or not?
4. What if you are on payroll for 2 employers at the same time? Does this effect in any way while adjucating for 485?

NSC is taking almost an year to process 140s .. I totally understand your situation ... There is a sliver of hope though I read somewhere that 140s with older priority dates are being adjudicated faster than the ones with newer priorirty dates...
Hopefully your 140 is from a company with strong financials and documentation.

I was wondering if anyone has a clue as to in what order are they processing the EADs.
Because I put in random numbers for EADs with notice date Oct 11th (same as mine) and I cannot seem to find a pattern.
Are they processed totally randomly?????

Is it ok to have a gap between H1B expiry date (say July 31, 2008) and start of EAD (Oct 1, 2008) when a person is in AOS?
I would think it would be okay since AOS is a status (not EAD) which you maintain. EAD just allows you to work for anyone (but not maintain status. For status you use AOS/485)

As others suggested, contact good attorney. I know people are doing it and were lucky not to get I140 revoked.
As you said, AC21 not done means you changed employer within six years of your H1 after I140 approved, is it?

In the end what does it matter whether you get an RFE you can't turn around in time or they sat idly twiddling their thumbs. In the end you are relegated to waiting another year to return from retrogression land.
However you are right, one of those times was an RFE for the tb test invalid that I had to do the medicals all over. My scramble to get it all done was 3 days late and costed me another year.

With all the opposition that all the immigration bills are facing, I see little light for them. But how about we call the offices and request them just to end the 'country limit' on Employment based Green Card. Let the Employment Based Green Card be given thru a Fair system and that should be FIFO, when there is no quota on the number of people that enters the country for employment, it is unfair to have a Country Quota for Green Cards. If they can come up with a 5 Line Bill for this, this bill will have least opposition...
The Kings/Smiths and likes can come up with 50 line amendments to a 5 line bill.

Before we start contatcing them please make sure what we need...
Two simple things
1) Elimination of All backlog immediately. Everyone retrogessed to get gc on day one. None of the new guys illegals to get GC unless all legals pending as of then(EB and FB), have got thier GCs no matter which country quota crap or FB to EB and vice versa bullshit.
2) Citizenship relief for retrogessed.
3) In future if there are not VISA numbers lost, if so they need to be used to next country. and more clear definition of EB-FB , FB-EB w.r.t country quota.

About 6 engineers left our company in the past 6 months and my boss was not able to find replacements despite aggressive hiring efforts.
