Hey Guys:
I do not have detail about my RFE. But, I understand my wife & I got an RFE on our 485 applications. I have a concern, I was on F1 visa until 12/31/2003 and moved on to H1B visa on 01/20/2004 (without applying for OPT); so for those 20 days, I am guessing I was so called out of status. Am I correct? Can this cause a problem? I applied for H1B around 10/2003 based a full time job.

The Infopass IO told that my file is now at NSC examination room. He could not tell me what that means - whether it is already assigned to an IO or just waiting there for an IO to be available. Any one else heard this? My guess is: it's waiting for an IO to be available :(

Basic question which was not present in USCIS Update.
How to make sure that USCIS has updated AC21 information against the case. Knowing this will help to be less worried at port of entry (POE) when using parole. If the new employer information is not updated against the case, then the employment info that is specified to POE officer will be out of sync with the info that is available to him which unnecessarily leads to other questions.
Any suggestions to know if the AC21 info is updated against the case.

I did not know about cross chargeability! It might work very well in my case..
I am from India and I have my i-140 approved and waiting for my PD(Oct07) to become current to file for my I-485 under EB2.
My girlfriend who is from Portugal, is on a F1 visa.
So if we were to get married - I can change my 'chargeability' to Portugal instead?
Isnt the chargeability solely dependant on the nationality of the primary applicant?

(c) Exception for spouse. If necessary to prevent the separation of husband and wife, an immigrant spouse, including a spouse born in a dependent area, may be charged to a foreign state to which a spouse is chargeable if accompanying or following to join the spouse, in accordance with INA 202(b)(2).

I feel 'people not donating' is not directly connected with money. For example lets aasume tomorrow USCIS opens up a premium service for 485 approval saying you pay $50,000 and your 485 processing will be completed within 6 months and this queue has unlimited visa numbers. Will people not pay 50K and get into that queue? I would say 50% of IV members would pay and make use of that.
The point is not about affordability.

- Expect outcome ( easy way to justify your donations , current members who are contributing )

Just hang in there until the GC comes through then make your decision.
There is no legal law that prevents you from fighting it. The employer will fail, if he tries to force you to stay. All you have to say in the court of law is the truth, that is the employer forced me to sign this contract, otherwise I would have lost my job and my GC, and this was not discussed during initial employment offer. Make sure you have some kind of documentation, emails etc to prove this. The employer will get shut down by INS.
So stay quiet for now and when the time comes make a decision and move on. If the employer tries to threaten you, let him know the facts and he will back off. I am not telling you to go against the company, but if they come high-handed, make sure you can stand strong and speak the truth of the matter. Let them know that they cannot take advantage of your situation....... Make sure you have all the proof to prove what was agreed and signed in the past, which will surely deter the employer from fighting against you.

Hope things have becoming clearer.
Hate to sound discouraging, but any issue of prolonged absence can create problems.
I say 'can', only because of the vagaries at POE.
Even after getting the green card, it is not advisable to stay away for more than six months a year.....although people have done it.
Once the green card has been received, you guys can take a re-entry permit, which allows staying away for a longer period of time. I am not sure, but I think it is valid for two-years.
You had been asking about the pre-green card stage and I know I have been talking about the post-gc one.
My two cents on the pre-gc issue is go to a good lawyer....even if you have to pay top dollar. Apart from the advice, you will also have legal back-up, should you choose to send your daughter to India.
Lastly, have you considered having your daughter study for pre-requisite courses here while your green card journey reaches a destination. Then you can take a re-entry permit and breathe easy.

for people who are having problems with the swift3D file sizes in general.. try producing stuff as just edges.. leave those fills out. At least to see. You may not like line drawn stuff, but it's size is a hell of a lot smaller than with the fills.

I have not noticed any LUDs lately (in 2008 year) on my case. I did make sure that USCIS has my address correct on their file (previously, it was my attorney's address where they were sending all correspondance). I am also eager to see if there is anyway around by which I can make sure that USCIS has my new attorney on their file.
