Hi
I am Vietnamese and got master degree for Computer science at 5/2007 in US. Then i started working as Programming analyst for a India IT consulting company in NJ at 12/2007.
Before working for this company, i don't have any working experience in Vietnam or US.
Now (12/2010) my employer want to sponsor Green card for me.
I can ask my employer to put Master degree in the job requirement (for PERM). They are okay with that. I think it good enough for sponsoring Green card with EB2.
But when i talked to the attorney, he said that i am not qualify for EB2 because i didn't have any US experience before joining my current company.
He said that even i have been working for my current company for 3 years but this 3 years is not counted for eb2.
For eb2, i need to have at least 3 years of US experience before joining my current company.
I don't know if he is right or not. i think master degree is enough for eb2.
Please let me know if i go with eb2 or not. eb3 will take too long for me.

We should support these bills whole heartedly. I have visited the local Congressman's office and explained the issue. I have sent letters (not mails) to all the concerned judicial committee members (related to the Issa bill)
Contrary to popular opinion expressed in IV, I was suprised to learn from law makers that many of them feel that the diversity visa is an outdated provision which has no room in today's America.
Can we all write letters to the Congress Rep, Senators and other members who matter, requesting them to support the bills? No opportunity should be missed!
You may draft the letter the way you like but in the subject line please state: "Request to support Bill No. XXXXXXXXXXXXXXXXXX
I repeat and request, signed snail letters are better than Emails! This is slightly painful in this E-age, but it carries much more weight!

Hello Every one,
I am in a very complex situation, I will try my best to describe it. I worked for company A which applied for my H1B visa which got approved, in June'10 I moved to another company B as the job prospects are good. My Ex-employer A was not happy with that, he did not agree for VISA transfer. So my current employer B applied for another H1B petition which is under review now.
As I have a valid H1B applied by company A, my school terminated my F1 (OPT)status from this Oct 1st, which would otherwise get expired in March 2011. My Ex- employer(A) said that he filed for withdrawal of my H1B a week ago. I informed this to my current employer(B) and they have requested premium processing. I am worried what my status would be now, because I am no longer in F1 visa and my H1B is with another company for which I am not working anymore. Am I out of status?
Please let me know your suggestions/opinons. Thanks a lot for your time.

I second what "gcdreamer05" has mentioned above. Be patient until you get what you wanted and make your move. Tell / find valid ( or make ) reasons where your attorney cant play any more games quoting your employer regarding your I-140 Receipt#. Dont rush and make any urgent moves and jeopardize your valuable that you already have spent towards your GC journey and re-invent again. Who knows how the situation is going to be in future wrt GC process. Good luck. My2c.

All, i got my visa stamped in calgary last week with no problem. Collected the passport the next day. They captured the previous visa date remaining with the new work permit and got the stamping till 2012 july. Filled the new I-94 on return and gave back the old I-94 that time.

I know a few good friends (GC or citizens) who will be willing to do anything to help me - they were once in the same boat and/or have seen their close friends suffer with pathetic priority dates, layoffs etc.
However, lets face it - we can't expect active participation from them - in terms of logging into IV and looking at action items. What we can expect is prompt action if an IV member (like you or me) approaches them with very specific action items. We have to do the groundwork - for example, if the action item is to send a letter to your local senator, we have to take our friends' zipcodes, find the senators and let them know the specifics - where to send, what to send.
I am all for this. I am sure everyone has a few friends who recently got their GC, or received it many years ago in the good old times and are now citizens, or relatives in another state.

I have applied on 3rd feb 2011 but still they say the processing dates for H4 applications is 16th Jan 2011 as of 18th May but it has remain the same for last 2 weeks as what I know.
I m in disguise too, whats next.
I have my NTA court date in early June.
Plz reply about your update.

If you dont have a degree in the required field in your case computers , how do you expect USCIS to approve your petition, I think you should file labour in a category which does not require a computer degree.

Is the transit visa required only if you want to get out of the airport? Is it also required if you just have a 1-hour stop over and you will catching the connecting flight?
