I am not a lwayer or an expert in any case but I think you may file for an appeal or MTR for the denied labor if you are still within 1 month period upon receiving the denial. Then once the status is changed from "Denied" to "processing", you should be able to apply for a 7th year extension... In the meantime, you may file for new PERM under different position. Again, I am not a lawyer nor an expert.

Lets figure out those small things that can happen in the near term. May be that brings more happiness in the short period than eyeing for the whole turn around of the retrogession. which doesn't really seem to happen before the presidential election. Lets be practical about what are the most important concerns of the community than trying to absolve the system of all problems.
I guess we may also need to think from the bottom up with small things than from top to bottom of getting rid of whole retrogession which doesn't appear to happen in the short term. This is not to discourage people from working on ending the retrogession but just to be practical enough to solve the immediate problems for the community.

Hi,
One of my friend got fired today, he is on H1b. His American consulting company has sent visa cancellation as well to USCIS today. He has job offer from a big company sent visa transfer papers to their attorney 2 days back but they are saying transfer application preparation will take 1 week (you know how big companies work). What are his options?
Will he be in trouble if visa cancellation reaches before transfer petition? I heard employee have 10 days time to find a new job? Please help this is panic situation for my friend.

Thank you so much for your reponse.
I'll work with the attorney on the response letter explaining that Kumar was added as a cultural thing and was never part of my legal name. Will also send in Passport and School Leaving Certificate as evidence which has the name correctly.
Any other backup plan? Will doing additional affidavits, from the same persons (parents & relative) who gave the earlier affidavits, explaining the Kumar discrepancy serve as legal binding document & help?

FYI...
Checked my bank account and the AOS, biometrics and EAD checks have cleared. Filed on June 30th and received at USCIS on July 2nd. The receipt numbers are on the back of the check.

The brief info below is our basic background:
Perm EB2，
LC Perm PD：10/2005，approved in 11/2005 at Chicago；
140 RD：01/17/2006， approved on 01/23/2006 at TSC；
485 was delivered to NSC on June 27, 2007, no receipt yet.
In order to track if there is a LUD on my I-140 to check when the receipt could be mailed out to me, I checked my I-140 status this morning. From the info above, I expected to see if there is LUD or not. To be super surprised, I found the following info:

In terms of the worst scenario, do I need to reapply I-140? If this is the case, shall I concurrent file I-140 and I-485 before Aug 17th? I am a June filer. I still don't get why I am put into such a big trouble!

About 6 engineers left our company in the past 6 months and my boss was not able to find replacements despite aggressive hiring efforts.
So he decided to outsource project verification work of about half a million USD to HCL India.
I should have called these jerks at NPR and should have told them to send some of these so called unemployed engineers over to our company.
When the DOL is repeatedly pointing to the fact that the current unemployment in EEs is below 2% I dont know where these idiots get their numbers from.

What do you guys suggest at this point of time?.
Is there any interview to be setup for me soon at consulate?.
Can I go ahead and attend the interview even though AOS is filed with USCIS?.
I talke to USCIS, they said to write a letter to cancel the AOS application (They are not going to refund the money, which is around $1000.00) if I plan to attend consular process. Please suggest the best option. Thanks

I understand I need a transit visa and would like to apply for one in US. I am flying Emirates and believe Emirates can sponsor for the visa. They told me to use CIBT (http://www.cibt.com) for applying for a visa. On the cibt site, it asks for a unexpired visa or a Green Card.
I wonder how others with expired H1s have got transit visa to Dubai.
