hi very useful thread, my wife who was working back home cannot work here as she is on h4 (no EAD yet).
We too started cribbing about it, and few months passed, sitting at home just makes one go mad, so decided we wuld go to school and may be try in h1 lottery this year....
So i would suggest not wasting the time for all those h4 ppl and try to make some meaningful use by either going to school or trying to find out who can sponsor a work permit etc...
I am all in for this, and am ready to support this initiative....
But we first need to clearly lay down what is our proposal,
a) Are we talkin about allowing H4 people to work (like how L2 can work)...
b) Are we talkin about providing SSN for h4 people so that they can get stimulus benefit...
With new obama govt i am sure if we collect together and lay our proposal , they may atleast think about it....
Even if not giving work permit, they may atleast help us get some stimulus benefit...

To change representation to self, i don't think we can use G-28. (as i gather from reading several threads on this topic).
Yes, you can. File new G-28 and list yourself as your own representative. G-28 goes to the same service center where I-485 is pending.
After USCIS receives new G-28, they will update attorney info.

And the government knows about it. The arrest of Nick Mandalapa who was seeling labors openly on Sulekha and now the introduction of the rule banning labor subs is a step in the right direction.
I do realize that there will be a ton of substitution happening from now until April 13th, but I am optimistic that the folks approving these would be keeping an eye on this and will most likely reject the application.
Unfortunately the greedy will still take the risk and make the immigration lawyers wealthier. I am not sure letting Lou know about this would help us in the long run. Knowing him, he'll start portraying it as every H1B holder does this!

Jimi:- please do update when you get additional information, thanks for the links. My lawyer simply said that this is routine. I am already inches near the breaking point.
I contacted my attorney's office. They are also puzzled why the case has been transferred because this is an older case and an original California application from beginning to the end. I received the Notice of Action (140) and I sent to Nebraska the 140-485-765 July 30 and they received it July 2.
It was sent to Texas and I got the copy of the Notice of Action today from the lawyer, I guess they will cash the other checks since they change the visa bulletin on July 17...I don't think they will reject the 485 or 765, I am sure they will process at least my 765.

I suggest use two words as much as possible and we need to make this as buzzwords, refer to these words from recent Bill Gatest testinomy

It is very important for common people to know that most of us waiting for greencard are already here and we all have decent paid job, this means by having green cards we are not taking away anyone's job, Also, by denying/delaying greencards we are forced to return back to our respective countries (India/china mostly) taking away our jobs with us, This encourges more outsourcing and many greedy coroporates are making use of it to the fullest,
To keep American jobs in American we need to incource more Highly qualifed people into the country so that they can work and compete in a fair market.
Many corporates are encouraging their foriegn born engineer to go back and work for them from their native countries, they are offering excellent salary pacakge interms of local market, it is win-win situation for many engineers at the cost of American economy, since these Engineers not only take thier jobs with them but also take many other jobs around them, as they back and train more people in their homeland.
Many other countries are also gaining by America's loss

Why? what is so special with your finger that you are so keen on showing them to so many people?
It is common knowledge as to how the so called "desi employers" work, and it is also a common knowledge as to who (and under what circumstances) joins such companies -- only to crib later about the employer and his practices (even though it is due to other odious practices of the same employer that the person was able to get (buy) the job in the first place).
I have no love lost for these kind of people, most of these people misused the law through loopholes to buy their labor certs, and made a mess for people who have been honestly waiting for their turns. (Why else, will there be a pre 2000/2001 PD apps still pending. USCIS is bad, but come on, that bad??).
Going back to OP, initially I gave him/her the benefit of the doubt, but his/her later statement "I will make sure that the job title and description are the same on the offer letter... " clearly points to gaming of the system. If she/he were on the up and up, she/he would have got a job offer that is similar to his /her LC job description, and not get a job and them make the offer similar to LC.

yes. You can keep changing jobs as many times as you want, invoking AC21. Keep sending USCIS a new G28 and Employment Verification Letter whenever you jump.
To apply AC21 what lawer needs to do? Just file G28? or ther any other documents required from original employer?

As others have suggested, you can always go back to your previous employer. I have been in similar situation as to go back to the previous employer, after working with the transferred H1B for 3 months. My new employer was even worse than the previous one and I decided to return to my previous employer. I worked for them for 2 more years and then did a smooth H1 transfer to a 3rd company and working for them since.

Sorry that a lot of people feel that immigrants are the reason why millions of people are not getting jobs. H1 quota is only 90000 a year. Of all the people getting off the boat on H1, some have already got their green cards. Say even if the number is 500000 in the waiting, still leaves the number to half a million short of the original millions that do not have a job. The problem is not H1 visa. The problem is the greed in the higher echelons of the corporations. If you give all these H1 holders a green card then you will have at least 250000 wanting to buy a house, a better car and invest back into the economy. So where did they go wrong, is it because wanted to play by the rules, was this their biggest folly. Once again sorry that so many feel that immigration is the problem.

Thanks for all replies! I worked with 2 companies. I am getting a letter from HR of one company and for other company, the letter is from my ex-boss (both on the letterhead)
"Systems Productivity Engineer" is mentioned as the alternate occupation in my labor. The RFE mentions that I need to show experience in the offered job, or in the alternate job for a minimum of 12 months. So as I understand it, they are asking for experience letter in the alternate occupation (Systems Productivity Engineer)...is my understanding correct? If yes, my question (please excuse me for the repetition) is - Does USCIS check exact match in job title?

My previous company is refusing to give me a official experience letter..even though i worked there for three years..
I am ready to file for my 140 and my attorney initially said that two Notarized affidavits from employees at the firm who worked with me will be good enough..
now he is saying he is not sure if USCIS will accept those affidavits...
has anyone used such affidavits to prove their experience.?did it work
Will USCIS reject 140 because of this or will they issue an RFE...
can i send the h1 approval that i had with that company as a proof of working.

Pay them some money and get the letter. Personally, I have gone through the same situation and in my case NSC had sent a RFE demanding experience letter despite having co worker affidavits. So it may not work, for some people it has worked. If you get an RFE, USCIS will give you max 45 days to produce a letter and trust me its a very short time to get the letter from an uncooperative employer. Nor is confrontation going to help as there is NO law that requires your employer to provide one such letter. Hence, I would say use all your network and contacts and every trick possible to get the letter.
