Thanks for the atta boy, however, I will give a pat on the back and a whooping attaboy, and perhaps even a glow in the dark salami with their initials on it, if someone, anyone can help me find a way to reverse this. My Fla is frellin 9 megs now because of Swift 3D or Flash or whatever. Life would have been so much easier if I could allow people to view my Fla and help correct foundational errors. But who wants to download a 9 meg Fla just to answer a question? I know now why snoopy spent all his time on top of his doghouse; It was as far away from the computer in the house as he could possibly get. :( (FRELL!!!) I removed everything, but it's ghost remains, haunting my Fla. Put this one in the K-files.

The response has been sluggish, especially due to people who just visit this website and hope that "others" will work on this issue and get this resolved.
However, as far as the rally goes, its too early to tell whether we can do better than illegals in terms of showing up for our cause or not. I guess we can and I hope to see it.
Someone from Northern VA, DC, Maryland, please volunteer and contact black_logs@yahoo.com to seek permit for public rally near capitol Hill/White House etc. Without that permit, this isnt going anywhere. Others please sign up on the thread titled "Sign up for rally for legal immigrants".

I had issued 2 cheques $745.00 in the name of USCIS and my file is received by them on july 2nd. Now one of my friend was telling me that cheque should be in the name of Department of Homeland Security. and not USCIS.
Is this true? Are there any chances of rectifying this? Would my application stand chances of rejection for this? or cheques can be issued on any of these agencies and it would get cleared?
Kindly clear my doubt. I got tensed from the moment my friend told me this.

Issueing 4 separate checks is recommended for obvious reasons.

I know a few ppl for whom PERM was filed in March/April/May and they have received the approvals. Not sure why other cases will take longer time though.

Nothing can motivate politics more than public opinion and that's what we're sadly lacking at this time. Maybe we need to launch some sort of public relations drive; we need to let the American people hear our voice first so the politicians will listen. However, some guidance from CORE and our public realtions firm would be nice?

I actually made someone in my family do this when they changed houses as they had no idea about this (GC holder for 15 years). that person was so mad with all the rules WRT transit visas (travels extensively) that they decided to get their citizenship finally. :-))

most think retrogression and unavailable visas are problems of GC. In matter of time they will fix it (1-2yrs). CIR bill at the min. will fix recapture which should resolve it. I feel the next hurdle could be the H1B and GC process scrutiny + the job market to maintain your h1b till you get GC.
Earlier they used to layoff if the company didnot perform, well today, they layoff either way by outsourcing to earn more $$$

Since we do not have citizenship, we can make ourselves matter to citizens. When we realize that average American citizens are the people whom we need to team up with, politicians will start listening to us. So far we have been teaming up with illegals.
It is often said (and it is very correct) that divided we fall. So we have to stand as a team to success. The question really is, whom would we team up with?
You are mistaken if you believe that the dems support amnesty and the reps support legal immigration. The fact is that they support themselves and will take on a policy that will get them re-elected.
We do not matter until we make ourselves matter by holding them responsible....... hard to do without citizenship :(

Lets send the letter to all the congress members and schedule a follow up meeting. Ask for their help to pass some resolution to ease the GC long line.
I will take the responsibility to modify this letter a bit and sending to GA congress member. Sending the letter and educating the congress member need to be done by the end of Jan'2007. What others IV member think? Any taker from other states?
I very well understand that sending this letter may or may not get the resolution passed but at least we can educate them of the monterous GC problem.

SEC. 508. VISAS FOR INDIVIDUALS WITH ADVANCED DEGREES.
(a) Aliens With Certain Advanced Degrees Not Subject to Numerical Limitations on Employment Based Immigrants-
(1) IN GENERAL- Section 201(b)(1) (8 U.S.C. 1151(b)(1)), as amended by section 505, is amended by adding at the end the following:
`(G) Aliens who have earned an advanced degree in science, technology, engineering, or math and have been working in a related field in the United States under a nonimmigrant visa during the 3-year period preceding their application for an immigrant visa under section 203(b).
`(H) Aliens described in subparagraph (A) or (B) of section 203(b)(1)(A) or who have received a national interest waiver under section 203(b)(2)(B).
`(I) The spouse and minor children of an alien who is admitted as an employment-based immigrant under section 203(b).'.
(2) APPLICABILITY- The amendment made by paragraph (1) shall apply to any visa application--
(A) pending on the date of the enactment of this Act; or
(B) filed on or after such date of enactment.
(b) Labor Certification- Section 212(a)(5)(A)(ii) (8 U.S.C. 1182(a)(5)(A)(ii)) is amended--
(1) in subclause (I), by striking `or' at the end;
(2) in subclause (II), by striking the period at the end and inserting `; or'; and
(3) by adding at the end the following:

`(ix) the number calculated under paragraph (9) in each fiscal year after the year described in clause (viii); or';
(2) in paragraph (5)--
(A) in subparagraph (B), by striking `or' at the end;
(B) in subparagraph (C), by striking the period at the end and inserting `; or'; and
(C) by adding at the end the following:
`(D) has earned an advanced degree in science, technology, engineering, or math.';
(3) by redesignating paragraphs (9), (10), and (11) as paragraphs (10), (11), and (12), respectively; and
(4) by inserting after paragraph (8) the following:
`(9) If the numerical limitation in paragraph (1)(A)--
`(A) is reached during a given fiscal year, the numerical limitation under paragraph (1)(A)(ix) for the subsequent fiscal year shall be equal to 120 percent of the numerical limitation of the given fiscal year; or
`(B) is not reached during a given fiscal year, the numerical limitation under paragraph (1)(A)(ix) for the subsequent fiscal year shall be equal to the numerical limitation of the given fiscal year.'.

Now, from employer or the H1B/L1 Sponsor/Petitioner, you are suggested to carry these documents, It does not say mandatory, but says suggested. (Substitute L1 wherever you see H1B for L1 visa holders)
H1B visa Petition and Supporting docs filed with USCIS
Employment contract letter signed by you and the H1B visa sponsor
Your H1B Sponsor?s Income tax returns of last two years and Financial statements
Notarized list of all the H1B Sponsor?s employees at the listed job site with specified information about each employee.
H1B sponsor?s State unemployment wage reports for wages paid to employees within the state
Letter from Client company regarding project and copy of contract between H1B sponsor and client with all the details of time of project, agreement, etc
Copy of contract between H1B sponsor and the job site ( the location where you will work)
Letter from job site that there is a vacancy for you to work there
A detail report on the project that you will work on at client including the technical details, time line, current status, employees assigned, etc
You will have to carry these personal documents as applicable
Your personal license to practice your profession in America
