We should be ready to file law-suit, if AILA is not filing as well nothing favourable to us. They may have back door deal, it may not be deal for us, may be deal for AILA.

I am located in Dallas with I-140 approved. Since my project is ending in Dallas, I have found another job with the same company in Chicago.
But my HR and the Layer is saying that, if I move to Chicago then I have to re-do whole process again starting from labor.
Could some one let me know if they are correct? What will happen If I change the location without refiling labor?

I changed my address online.
Checked with CSR and IO and they confirmed the new address..
I didn't mail the AR-11 form though.
I didn't get any mail from USCIS about the change of Address on my applications.
Is that fine.?

Do not take chance. Send AR-11 with certified mail. It would not hurt you to spend some $ to have secured feeling.. USCIS has suggested to do both on its web site...So do it.

While Bobby may not have gotten back to us about the results of his petition, I can say that consulting an AILA Lawyer (http://www.aila.org) might actually be very helpful. Also, 40 resumes isn't that bad, it's not a small amount, but still not the end of the world.
It really depends on the job ad text and educational requirements laid out in the perm legal ad filing, e.g. the newspaper, & whatever else he or anyone did for recruitment. If the job ad text was too vague, then you might have cause to worry. It's an opportunity to reject the case from the Dept. Of Labor PERM Certifying Officer's (http://www.foreignlaborcert.doleta.gov/perm.cfm) point of view.
If it was highly specific to Bobby's (or in this case anyone else) credentials then you have a much stronger hand.
Often a PERM recruitment advertising agency (http://www.perm-ads.com/services.php) is a good option, because you can have the ad vetted from hundreds of ads the agency already placed. They will know which ones got rejected and be able to consult a small amount on the issue at the time of the ad placement.
So one point is to always make sure to have very very exact job requirements, including educational ones. But don't try and use foreign language requirements.
As for people trying to debate about the process, it's a political issue no matter where you live in the world. Anyone going abroad for anything longer than 3 months will learn the lesson that it's better to be fair and equitable toward newcomers, after they themselves are subjected to scrutiny and almost always denied basic rights we all know are fair and just.
It's hard enough to get basic information, but when it comes to the law here in the US, my point about retaining an AILA lawyer is because opinions on either side are moot. The law is the law. Get represented by someone who knows it well, and is part of a respected legal association/community.

To judge the immigration credential, it will be good to take a look at candidate's websites and check Issues -> Immigration section.
Obama supports increase in visa number for legal immigrants. Hillary does not say anything about it. She does oppose guest worker program which allegedly exploits American worker by undermining their wages. Have not we heard it before from anti-immigrant lobby.
There was another article on CNN blog ticker sometime back which mentions:
"but the details of the study suggest the Clinton and Obama's voting records are not as far apart as they appear in the rankings. Of the 65 votes included in the study that both senators were present for, they only differed twice — on a measure that sought to establish an Office of Public Integrity to handle ethics complaints (Clinton voted no, Obama yes), and on a measure that sought to allow certain immigrants to stay in the united states while renewing their visas (again, Clinton voted no and Obama yes).
I think Obama is better in terms of pro-immigration reforms.
On Republican side, both McCain and Huckabee are sympathetic. Huckabee has more clear agenda on this. As per his website:

What is the authenticity of this statement. you mean to say that USCIS may come out and say on 20 july that they are not accepting any more applications...But I think it shuould be always mentioned in bulletin and that will be for next month...

We all are in the same "boat"-named retrogression...So let that feeling of solidarity be an enormous strength in you and know that we all want you out of this lay-off mess, ASAP.
I too was laid off (EB2, due to USCIS "affirmative misconduct"PD became Aug 06 (previously Aug 04), I140 approved, I485 pending more than 24 mths, have EAD but havent used it, renewed H1 till 2011, laid-off, no severance --- thinking about applying for unemployment).
My field of employment is few and far between....but hey....I need to keep looking at this crisis as an opportunity...and take some time off to do things I haven't done for ages...My spouse too is working on EAD.
Such a feeling of solidarity, to know there are several of us in the same boat :)

Hi,
I received my permanent green card based on marriage to US citizen, valid for 10 years last month. Now, I am planning to travel to India after close to 9 years, but I am extremely concerned about returning point of entry issues and I wanted to see what would the community suggest.
I came to the US in Fall of 2002 on a student visa. Around aug - 06, I went out of status. Right around then I met my future wife who is an american citizen, we moved in dec of 06 and got married in Jun 07. Due to financial hardship, we couldnt apply for my AOS/GC up untill late Oct last year. [Oct - 2010]. We hired a lawyer and every thing went pretty smoothly and fast.
I had my EAD approved within 45 days and I got my GC interview after a month. We [me, wife, lawyer] went to the meeting and everything went great. Our interviewing officer just took 20 mins to question us and we received my Permanent GC [not conditional] in the mail shortly there after.
Now I am planning a visit back home for one week, because I couldn't get more days off.
I am just worried about my return step to US at the port of entry. I have been reading and I learnt that I just have to present my country passport and physical green card to the officer who will then scan and ask questions.
What kind of questions can I expect from the officer?
Will he be asking me questions about my past as in when was the last time I came to US?
Why I was illegal/out of status of close to 4 years and questions about our marraige etc?
When applying for GC we collected lot of documents to provide to the USCIS that our marriage was in good faith such as joint bank accounts, pictures, leases etc. Should I take all those documents with me when flying?
Will taking a certified copy of my marraige certificate beneficial along with the supporting documents?
It feels like another "meeting" with USCIS where I have to show proof but I am really concerned that I dont get denied at the port of entry.
Also, after I got my EAD, I moved to another state to work on a contract position for couple of months. I consider my actual address as the address I applied my GC which is in another state, since this is just temporary job. I already mentioned this to the officer at my interview and he noted my current location/job title etc during that time....should I do something about it?
Sorry about such a long list of questions. Its just that I havent travelled out of country in such as long time and I dont know what issues I could face and what I need to carry with me so that I can be allowed back into the country upon return?

If i enroll back in school through open university and take courses that counts towards my graduation will that help in convincing the Visa officer that I have not abandoned my intent to earn my masters degree....

This should help as a backup plan if at all they ask you about u r MS ...!!!Bottom line is show ur intention to achive for what u came for without jeoperdizing u r job.
Remember...99% of what we worry never happens. U never know..they may not question about u MS also...!!!!:)

There is good chance that 01/01/2005 will stay for a few more months. Trackers show a quite big number of pending ROW cases from 2004. But if they decide to move it (I hope to), it will go to Jun 2005- when first Perm cases started.

I would say in the big scheme of things it does not matter. You need the GC and the employer needs you to work with him till you get GC. It is win - win.
First question to ask is, whether you can chalk out the GC expenses from your pocket, if not let your employer pay it. Why are u thinking of leaving, even before starting....If you want GC, it is advisable to stick to one company....I have suffered a lot, by two layoffs and lost GCs....I have spent $20K until now in H1 and GC fees, so if your employer is paying...take that as a benefit that other employees are not getting.....But the choice is yours..

They may eventually give Citizenship to "illegals". Legals will be in the same dark room as we have been. Thats the situ we are in. There is no respite, though they say its "Comprehensive" immigration reform. Whats your take?
