I saw my wife's 485 get a SOFT LUD and was happy to see activity. Her PD is EB2 (India) December 2005. Now reading the posts here it looks like it was the EAD application she has that might have initiated it. I hope someone looks at her 485 and she gets greened instead of approving the EAD.
We opened an SR for her and we got response on Friday as application under review. We did a second level IO and that person told us that her application was preadjucated and this was 6th of August. Nothing has happend since then.
If your wife's date is current, she will get her GC soon.

If you plan to mail the documents, be careful to read the instructions. I just applied my passport to Houston CGI and misread the instructions saying it would take 10 days. It takes 10 days if you got your passport from the local Indian consulate in US but if it was issued by Regional Passport Office in India, it would take six weeks.
They have something similar to Tatkal where you can pay 90 dollars and get it faster. How faster, don't know.
Once you have submitted your application, you are at their mercy and Houston seems to be worse than Indian regional passport offices. Their phones are constantly engaged and they barely respect you when one calls them. You have no way to upgrade.
If you have the time and proximal to an Indian Consulate, I would try going in personally and get the work done.

Suppose i get the H1 extended for 3 yrs as well as transferred to Company B first ( based on 140 that is approved by Company A ) and i'm also working with Company A now - no issues. Now after the the extension papers reach my hand - I leave Company A by writing a nice and gracious letter and 15 day industry standard notice period.
Even after all the fomalities if Company A gets angry now because they lost the cashcow and to teach me a lesson 'revokes my 140' - WILL my 3 yr H1 extension (which is already approved based on that very 140) be also revoked and USCIS will reopen my case proactively ??
By the way - i'm not worried about impact on 485 - i know that remains protected by AC21 after 180 days - but i MUST NEED the parallel H1 to keep my wife in status in H4 until my PD gets current and she can file AOS.
From what i understand or interpret AC21 for H1 extensions beyond 6th year is you should have 140 approved/pending.
Once I-140 is cancelled by employer we can NO more extend H1 beyond 6th year and it automatically cancells the H1 approvals after 6th year since it was approved based on I-140.

My spouse's PD is Jan 2005 (pre-PERM). No sign of LC approval so far. Spouse is already on 8th yr H1 extension. Is it true that as per the CIR(if passed as is) we will not be able to extend the H1 any more? I am aware that we will have to start all over in new point system ,but if we cannot extend the H1 then we have to leave the country....my vote for this poll depends on the answer to this question..

I called USCIS [Nebraska] using POJ method but no body answered the call, waited for 3hours and gave up.
mine is also NSC-CSC-NSC transfer cases.
I called USCIS about it twice and both the times I received two different answers. During last week of July when I called USCIS first time they said that they will consider Sep 7th, 2007 not July 2nd has the receipt date. I called them again on August 8th and spoke to level II person. This time she acknowledged the fact that my application is outside the processing date and she will send an message to NSC. She gave me a reference number starting with WTC, then 10 digits and ending with NSC. (WTC123...NSC)

We sent it on June 8 07.
USCIS updated case saying that they recieved it on June 12th 07.
It seems I missed the bus this time. Our response was received on 06/27 and then there were LUD on 06/28, 06/29, 06/30 and even today.

Heldrich Center for Workforce Development at Rutgers University, said skilled workers from India and China are New Jersey's main attraction for companies weighing the pros and cons of whether to locate in the state or elsewhere. Another speaker, Rachel Friedberg, a Brown University economist, also mentioned that one in eight holders of doctorates in New Jersey are from India or China. Moreover, one in four medical scientists in the state come from either the two countries, as do just under one in four software engineers, she said.
The consensus at the conference was that skilled workers from India and China are so important that the state should take steps to ensure that the flow of arrivals continues, such as lobbying, increasing the number of temporary work visas.

I am in a similar situation. Sad things is, my employer's lawyer is also clueless on this. After the first f'ck up (filing EB3 instead of EB2), they are off to second one now in 2 months (refiling PERM in EB2). My i140 is approved based on the previously approved EB3 PERM. Lets see what happens.

After reading so much into AC21 i'm still missing something.
Please consider this scenario.
I'm in good terms with the original GC sponsoring employer and have an approved I140. I want to switch to an entirely diff job(or may be even unemployed) using EAD. I can produce an offer letter (at the time of adjudication or for RFE) saying this company (or if they go out of business a diff company) will hire me in the same occupation once the GC is approved. In that case will AC21 come into play? So do i need to worry about doing a same/similar occupation while on EAD if i have a future job offer?
I remember reading unitednation doing something similar.

what abt setting up a Business .....say a Franchisee Store? is that possible with EAD...I know its possible with H1..but the interest rates on the loan would be higher...what abt with EAD..would somone on EAD get similar benefits as one on a GC

The new job must be in the same or a similar occupational classification as the job for which the application was filed.
Though all changes of employment while the I-485 is pending bear some risk, it is best if the new job has the same or similar job title, duties, and salary as the preferred job by the original sponsoring employer.
