My I 140 applied on May 1st, case number starts with LIN...so it is being processed at NSC. I am worried about this, since I don't see any approvals from NSC lately, although the cases filed in June first week are approved. These cases processed at TSC.
Anyone knows the timeline when I 140 premium will start?
My H1 expires on Spet 11 and I need to get extension.
Mine had a RD of May 1 too at NSC. I checked the status for the first two weeks and it said it would be approved in 150-180 days. Now it just says that it is being processed, without any mention of the days it might take.

The name calling has happened to me and has happened to my friends. I had never heard the name Macaca.
Every Indian in India has a Macaca like name. Based on this, I have no reason to complain about George Allen. I don't see why any Indian Indian should complain about it.

I got back from Can on 7/22. I didn't know at the time, but checks were cashed on the 16th (I left on the 19th) and Notice date was apparently the 18th. Had no idea of all this till 2 days ago. So it was in the comp when I met the airport IO and they said nothing about it either.

Get the medical done asap. Apart from that, I am not sure there is any requirement to stay in the US. Lawyers's offices are getting pounded with calls. So I am sure, you will have lukewarm response for a few days until the frenzy settles.

There is no irony, he is very right. The only injustice with Indians and Chinese is with the comparison to other countries. After all America belongs to its citizens, they come first before the frigging H1b body shops and outsourcing pimps. hey Guys,
I live in Canton, MI (suburb of Detroit, MI) I am on H1b visa and I have valid I-94 expiring September 2011 and planning to travel to Canada over the weekend to catch up with friends...i have few questions, i would really appreciate if you guys can help..
1. Is it safe to travel to canada on h1b visa? are there any issues that i could run into at the port of entry while coming back? i have been hearing really bad stories (it could be just stories) from all around, about people on h1b being denied entry to US at Port of entry while coming back from home country and all that sort. Am i going to run into any such issues if i'm just going for the weekend (leaving friday evening, returning sunday evening).
2. Lot of guys on this thread are suggesting not to hand over I-94 to visa officer while entering Canada, my I-94 for is stapled into my passport. Will visa officer at port of entry to Canada take this out? and will i be issued new I-94 with same expiry date (Sept 2011 as it shows on current one) when i enter back to US?
3. I am planning to travel with my wife and she is in H-4, again will there be any issues at Port of entry while coming back to US for her if she is traveling with me?

We did exactly the same thing earlier this year. No problems. See my earlier post. Take the printout of the US consulate document and in case of any issues ask to speak the legal officer at the point of entry. 99% of the people I know make it through with out any problems as long as they have not stayed for more than a month and have not applied for visa renewal.
Your I-94 will not be removed at the time of exit from US and you will not be issued a new I-94 unlesss you have the I-94 that comes with I-797.

My employer will not give me a copy of my old approved I-140 so in this case how can I port ?? Don't I need a copy of old I-140 to port priority date to EB2 or can I still port on the basis of the receipt number. I do not have copy of receipt also, I jsut have the receipt number for old I-140.

I am in a somewhat similar situation (EB2, PD May 06, I140 approved, I485 pending more than 15mths, have EAD but havent used it, still on H1, laid-off, on severance for a few months). Based on my conversations with lawyers my understanding is:
- The 485 application won't be affected even if the employer retracts the 140, this is because it's been more than 180days since the 485 application.
- I can change jobs either through an H1 transfer or using an EAD - lawyer recommended H1 transfer since it gives you something to fall back on (and more time) if a NOID or something is issued on the 485
- If its an H1B transfer try and do it before the last date of employment with previous employer. However in some cases a reasonable gap is acceptable. But if you can't find a company who'll hire you on an H1B transfer, no big deal, you still have your EAD. (Btw, there's some law about moving from H1 to EAD and then back to H1...not sure about that, please do your research on that ....or if somebody else can throw some light on it)
- Technically, you can sit at home and not work. The only catch is that WHEN the 485 gets approved they might ask for an employment verification letter ie. prove that you are currently employed when the 485 is approved. Given your 2006 PD you don't need to worry about 485 approval in the short term.

Question? Did you send a combined check for all the amounts together with one check? (325+170+180+70) 745? If you did, I guess as per the filing instructions on each application, they require applicants to cut seperate check for each application. could you please confirm with an attorney.
My lawyer sent only one combined check ($ 745) for all the applications and it was accepted.
But its always better to use separate checks for each application.

my comment is with respect to the bit about us getting justice!! melodrama will not get us anywhere. IMHO there is no injustice being meted out here. Our situation is a mix of a broken system and, supply vs demand.
also, please keep in mind that the core group, after working with QGA and various members from both parties, has a very good understanding of the way the system works. you have to change this from within. marching and screaming and hollering is going to get us no where.
as for help, I have seen many memebers offering to help. when someone from the core group says that all the help we need now, is money and more members, why can we all not just HELP by contributing and getting more people to join??

Weekend hobbies: visiting 3 places, Patel brothers for Indian groceries, another Indian store for Indian movies VHS cassettes and American store/gas station for milk/bread etc... ;)
How do you spot an Indians house
1. Picture of Lord "..." at entrance. Folks I citing what Fairfax cops said, don't label me. I myself was surprised to read
2. Toyota and/or Honda in driveway if you are OK. Mercedes/BMW/Lexus if rich
3. Husband mows lawn and front yard least beautiful amongst neighbors
4. Mostly stay in-house, even during summer. Spouse (wife) rarely (maybe never) seen conversing with neighbors shorts wearing blonde.
5. Religiously leaving at 7:00am and returning no earlier than 6:00pm Mon thru Friday. Working even when people are being fired right&left.
6. If ever going for vacation never shorter than 3 weeks
7. Doing grocery always on weekends.
Evidently, we all do many of these ourselves ... me too:p.

I am listing out what exactly, I have done and my EB3 GC is still active without any trouble. My current employer filed for GC and they are about to file my I-140 in EB2 porting my EB3 PD.
1. Get a legible copy of your current labor certification.
2. Get a legible copy of your current I-140, not the courtesy copy.
3. Get your H1 transferred. H4 is not needed to be transferred as the petitioner on H4 would be you or your current attorney. I would suggest you do a premium processing for H1.
4. DON'T give resignation notice until H1 is approved. Your new attorney might say, once filed you can join the new employer. NO don't do that in the current JOB environment.
5. Once H1 transfer approved, submit a polite cordial resignation letter. If you want a draft PM me. This is important to have a good relationship with your current employer. How ever bad your current employer/manager be. Just be polite.
6. Once they accept the resignation, get experience letters, you might need a corrected letters later once your new employer starts your new GC. The reason why I am asking you to be polite is for that. You might need to contact them again to get a corrected experience letter.
7. Start your new Job.
8. Do a address change if you are moving to a different place AR11. Do it online and make sure to say that you have pending applications that will trigger updates to your I-485, there will be LUD (Last Updated Date) changes. Do it for both yourself and your wife.
9. Now have your new attorney/new company file for G28 - "Change of representation". Along with this you need to submit AC21 support documents.
a. A letter from your new attorney that you are taking a different job based on your I-485 filing and pending for more than 180 days and using AC21 portability. Also he has to explain that your new job is "same/similar" to the job that you were doing. Provide the O*NET job code (Usually in the labor cert) and state that your new job matches with that old job code. Look up your code in this website O*NET OnLine (http://online.onetcenter.org/) and Justify your new title to be matching that. For eg. If your current job title is "Associate engineer" and your new title is "Sr.Software Engineer" an explanation as to why these two job titles are same/similar.
b. A letter from your new employer giving details about your new job and your duties, get those things in line with your current labor job description. And also should include the salary, don't worry about the difference, make sure it it not less than your current labor cert.
c. Include the AC21 memo attached.
d. Include the currently approved labor cert.
e. Include the currently approved I-140 copy.
10. When your new employer is ready to file labor, ask them to provide the minimum requirements for the job be Bachelors with 5+ years of experience or Masters. This is what makes your new job qualify for EB2. The next part is making you qualify for EB2, so if you are from India then make sure your Degree is a 4 year Bachelor degree and you have got 5+ years of experience already. Or if masters it should be 3+3 or 4+2 year Masters, in which the 3 and 4 are Bachelors (BSc, BE, B.Tech)
11. Once the labor is approved, file for new I-140 with a letter requesting for PD port from your previously approved I-140. You need to submit a copy of the original approval not the courtesy copy. I have explained this in detail in a different post, search for posts by my name.
At this stage if your EB2 priority date is current then you can interfile I-140 with the pending I-485. Then no need for step 12. If the PD is not current then you need to interfile when the PD is current.
12. Once I-140 is approved you have to interfile with your pending I-485.
Update: 10/01/2010. I got my and my wife's I-485 approved today. Yes porting from EB3 to EB2 works.
Then regarding the AP and EAD you can use it and your wife can use it. That will not be affected. In fact I got both mine and wife's EAD renewed for 2 years after job change and filing the AC21 documents. Also we have got new AP and traveled to India as well. And renewals of AP and EAD can be done by yourself, don't ask your new employer for all those perks, that will cause the new employer think about your new GC process.
Regarding the GC, just make sure that they agree up on at least on an e-mail from HR and or hiring manager. Don't insist that to be on your offer letter. E-mail agreement is more than sufficient.
Also it is safe to maintain dual status of H1 and EAD, like me and my wife do. That is a safety net just in case.

If your H1B has applied for COS then advisable not to leave the country, else (if it?s for Consular Processing) then of course I-94 won?t be there.
I wish and hope (as filed with premium processing) you will get your H1B before your travelling plans.
waitingmygc, The H1B will not be denied for the fact that you are not in the country but the extension of status. So you will get an approved H1B notice without I-94 and you will have to go for visa stamping to renter if you do not have an AP.

We will have lesser pain If we think as if we are living in some middle east country where no immigrant gets citizenship I believe ...they just keep issuing visa after every two years.
Thinking they will do something in favor of legal immigrants seems almost impossible in this economic situation. That too when they are not letting pass healthcare bill which possibly could be beneficial for Americans.
I have less pain now when I think I am in mid east with more freedom...I have to keep renewing EAD & any moment of time I could be denied and go back to own country..
GC wait is endless ...at least for EB3
